What is a collaborative divorce?

    Collaborative Divorce can save you time, money and be a humane way to
    settle your divorce case. Not everyone has heard about collaborative
    divorce, and there are still a lot of misconceptions about Collaborative

    Collaborative Divorce is a revolutionary form of divorce which the Office is
    very excited about. Collaborative Divorce began in early 1990's by one
    forward-thinking attorney in Minnesota. It has blossomed over the years
    and more and more divorce attorneys in Tampa and Florida are becoming
    trained in this area of law.

    The goal of the process is to work together with your spouse, the attorneys
    and experts to bring about a result that does not involve the litigation
    process. This is a different model than the litigation based divorce in which
    so many cases center around.

What is the difference between a collaborative divorce and the
traditional litigation based divorce?

    The litigation based model is flawed. It is unfortunately the norm in most
    divorces, but it has an inherent problem that the parties are not in charge.
    The lawyers are not in charge either. It is the Court that is in charge. The
    Judge is the ultimate decision maker, which is problematic when you are
    dealing with people's lives, children and finances. The Judge is doing their
    job by making the decisions that parties are unable to make. But make no
    mistake, the Judges are not personally invested in the matter, they do not
    have to live with the decisions as you and your spouse do. Therefore, when
    parties are presented with an option of making their own decisions, they
    would generally choose that road.

    Now there is another school of thought that critics of the collaborative
    divorce process are advocating.
    Well, there is mediation... and most cases in the normal litigation
    model end up settling. Right?
    That is true most cases do settle in the litigation model. But when? After 2-
    4 mediation sessions? On the eve or in the middle of trial? How much fees
    were unnecessarily expended on posturing. Posturing has become a norm in
    the divorce practice. Attorneys spend a great deal of time and their client's
    money making their client's think they are doing something for them, when in
    reality it can be a waste. William S. Foley is a strong proponent of mediation
    and trying to put clients in the position to obtain the best settlement possible,
    but sometimes it does not matter what intentions our office or our client has,
    it is incumbent on both sides of the matter to be reasonable and to come a
    settlement.

    The collaborative practice is different as the attorneys are required to
    withdraw from the case if the case does not settle. This is a scary possibility
    for everyone involved. And the attorneys do not want to feel as if they have
    lost. So everyone is invested in the process and they want to help their
    clients come up with the best alternative possible. This is all done prior to
    filing of the case, therefore there are no unnecessary hearings, deadlines etc.
    However, there are self imposed deadlines and agendas to keep the case on
    track as it is still necessary for accountability purposes to move the case
    forward.

    The statistics seem to suggest around 90-95% of collaborative divorce
    cases result in a settlement.
