Mediation is one of a variety of procedures known as alternative dispute resolution that is designed to produce results in the mutual interests of both parties. Mediation is appropriate only when all of the parties are willing and able to assume the responsibility of negotiating, making trade-offs, and accepting the results. Mediation is an informal, non-adversarial process in which decisions are made by the parties, not by the mediator. Family mediation may take several sessions because of the numerous issues involved such as support, equitable distribution, time-sharing and parental responsibility and because of the emotional nature of those issues. The goal is to facilitate continuing communication in an ongoing relationship between the parties, thereby reducing the post-judgment conflict. The Mediation is run by a neutral mediator, not the judge. Therefore, there is no ruling at mediation. The mediator is a facilitator but will not tell the parties what to do. It is up to the parties to decide if they wish to settle their differences or continue on to trial. We ensure that the necessary time and attention is spent allowing the parties to fully air their concerns and views to assure that our clients are satisfied with the outcome of the mediation. William S. Foley feels it is important to prepare with his clients for mediation in advance. It is important to know what mediation is all about and what some of the options a client may have available to them at mediation. Therefore, mediation preparation sessions with the client and attorney are normally scheduled and have been instrumental in the Office's overall approach to the each client's case.
